Halaty | Terms of Service

Welcome to Halaty! These Terms of Service ("Terms") cover your use of the Halaty app and services (collectively, the "Service") provided by Nandgate Studio ("we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Who Can Use the Services

You must be at least 13 years old to use Halaty. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

2. Your Account

  • You are responsible for any activity that occurs in your account.
  • You agree to provide accurate information (such as your display name and email).
  • We reserve the right to disable your user account at any time, including if you have failed to comply with any of the provisions of these Terms.

3. User Content

A. Ownership & License

You retain ownership of the photos, text, and other content ("Content") you post. However, by posting Content to Halaty, you grant us a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, store, display, reproduce, modify, and distribute your Content on Halaty for the purposes of operating, developing, providing, and using the Service.

B. Prohibited Content

We have a zero-tolerance policy for objectionable content. You adhere to the following strict rules. You may NOT post content that includes:

  • Nudity or Sexual Content: Any explicit or suggestive content.
  • Violence: Any depiction of real-world violence, blood, gore, or threats.
  • Hate Speech & Discrimination: Any content that discriminates against, defames, or promotes hostility toward any group based on race, religion, gender, nationality, or other characteristics.
  • Illegal Activities: Promotion of illegal acts or goods.
  • Harassment: Bullying or targeted harassment of other users.

C. Content Removal

We reserve the right to remove any Content without prior notice if we believe it violates these Terms or our community guidelines, or for any other reason at our sole discretion.

4. Rights and Ownership

A. Authors vs. Viewers

  • Authors: Selected users who have permission to post public Content.
  • Viewers: Users who can view, share, and interact with Content but cannot post public Statuses. We reserve the right to grant or revoke "Author" status at our discretion.

B. Our Rights

All rights, title, and interest in and to the Service (excluding User Content) are and will remain the exclusive property of Nandgate Studio and its licensors.

5. Copyright Policy

We respect the intellectual property rights of others. If you believe that your content has been copied in a way that constitutes copyright infringement, please report it to us at: Email: contact@halaty.app

We will promptly remove content that violates copyright law upon receipt of a valid notice.

6. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

  • Refunds: The Service is currently provided for free. If we introduce paid subscriptions in the future, we generally do not provide refunds for any fees paid, except as required by law.

7. Disclaimers and Limitation of Liability

A. "As Is" Basis

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, whether express or implied, regarding the Service's reliability, accuracy, or availability.

B. Limitation of Liability

To the maximum extent permitted by law, Nandgate Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. In no event shall our aggregate liability for all claims relating to the Service exceed the greater of (a) the total amount paid by you to us for the Service during the six (6) months immediately preceding the claim, or (b) one hundred US dollars ($100). If you have paid nothing, our liability is limited to the extent permitted by applicable law.

8. Governing Law and Dispute Resolution

A. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to its conflict of law provisions.

B. Dispute Resolution

If you have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting us. If a dispute is not resolved within 30 days of submission, any resulting legal actions must be resolved through binding arbitration or in the courts of Saudi Arabia.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
